Cal Harris' Daughter Testifies in His Murder Trial

Cal Harris' defense team argues that Jenna Harris should be allowed to testify in her fathers trial to show his attitude towards Michele and how he preserved her memory for their children in the years after her disappearance.

Harris is the Tioga County man charged with second degree murder for the disappearance of his wife Michele back in 2001.

After an offer of proof judge Bartlett did decide to let Jenna testify--but in a limited capacity--only about the photographs of her mother on display in the Harris household. During her testimony today Jenna testified that her mothers pictures have been in her room and in the Harris household for as long as she can remember.

Defense attorney Bruce Barket says this directly contradicts testimony from Barb Thayer, one of the Harris' nannys at the time of Michele's disappearance. Barket says Thayer testified about how cal wanted to completely erase Michele both literally and figuratively.

While the prosecution says this is a mischaracterization of what Thayer said during her testimony-prosecutor Paul clyne says that Thayer testified to going through Michele's things for a garage sale at the request of cal--and Jenna Harris' testimony does not rebut this.

Also on the stand today was retired New York State Supreme Court justice Elaine Jackson stack. Stack currently practices private divorce mediation. Stack explained how assets are distributed during divorce proceedings, specifically how the appreciated value of a business is distributed.

She testified that it is unlikely that a spouse who stays at home and does not work within the marital business would receive 50 percent of the appreciated value of that business in a divorce.
